Dr J is a general practitioner in private practice.   On one occasion, his friend Tony, an insurance agent, suggested to him a plan for earning quick money.   The Personal Accident Insurance Policy (PAI) offered by his company would provide insurance compensation for an injury caused by an accident resulting in death, permanent or temporary disability to an insured.   All claims under the PAI had to be supported by a form issued and signed by a registered doctor in Hong Kong.   Tony knew many construction workers and, as a first step, he  would  suggest  to  them  to  buy  PAI  policies  from  him.    These individuals would make claims later, even though they just suffered from minor injuries.   What Dr J could help was to exaggerate the seriousness of the injuries when filling in the worker's claim forms as the attendant doctor, thus resulting in higher compensation payments.   The “profit” could then be split among all parties.

Case Analysis

Dr J, Tony and the construction workers would commit an offence of conspiracy to defraud by colluding in making bogus insurance claims to deceive Tony’s insurance company for personal gain.

Dr J might violate Section 26.3 of the Code of Professional Conduct (Oct 2022) issued by the Medical Council of Hong Kong for issuing documents containing untrue information.

Alan operated a car rental company and had insured all his cars with Bryan, a manager of a bank's insurance department. Without the bank’s approval, Bryan bought an “old” car from Alan at a low price.

Bryan was the manager of a bank's insurance department. His old classmate, Alan, operated a car rental company and had insured all his company's vehicles with Bryan's department. Since they both like motor racing, they became good friends and often spent their holidays driving in the countryside.

On one occasion, Alan asked Bryan if he was interested in buying his 'old' sports car that was bought only six months ago. Bryan was interested but unfortunately was short of cash. Alan suggested that Bryan paying for it by monthly interest-free installments at a special price. Bryan felt uneasy about accepting the offer at first. However, he changed his mind as he thought the offer would not create any obligation to Alan.

Case Analysis

Bryan might breach the Code of Conduct[1] of the bank by accepting an advantage from Alan, i.e. the abnormally low price and the favourable repayment terms. Bryan should decline such an offer or seek approval from the bank's management.

Although the advantage did not seem connected to Bryan's official duties at the time of the offer, it might put him in a position of obligation to reciprocate in future and place him in a compromising situation when he was asked to return a favour.

工人丁:    西翼那邊還未處理好呀!

肥仔添:    快手快腳,弄得多少就多少。

工人甲:    添哥,監工來了。

肥仔添:    你好。

高佬全:    “高佬全”呀!你竟不記得。

肥仔添:    “高佬全”!小學時全班最高那個!三十年沒見了!

(二人熱情寒喧一番)

高佬全:    你還記得小時候的糗事?有次你把膠水放在何老師椅子,她起身時黏著整張椅子,整班同學哄堂大笑。

(肥仔添哈哈大笑)

肥仔添:    提到糗事,肯定是逃課去釣魚那次,你還有印象嗎?

高佬全:    當然記得,生呑蘇眉,弄得大家要到醫院洗胃。

(二人續走)

高佬全:    説開真的是,其實我未吃過真的蘇眉,遲些總要試試。

肥仔添:    噢!蘇眉,找天跟你一起吃過夠。

高佬全:    不錯呀…差點忘記驗查西翼那邊,現在去吧。

肥仔添:    吖…西翼…

高佬全:    甚麼事?

肥仔添:    沒有,都差不多收工了,不如下次再來。

高佬全:    我只是隨便看看,不致要多走一趟。

肥仔添:    (面有難色)但是…

高佬全:    但是甚麼?你不是有事情隱瞞。

肥仔添:    沒有,那裡呢?走罷!

(全電話響起)

高佬全:    等等,有電話。喂…知道!知道!

(高佬全掛斷電話)

高佬全:    真不好意思,我兒子發高燒,西翼那邊再約時間看。

肥仔添:    好!孩子要緊,那你快走。再約食飯。

(高佬全離去,添暗呼一口氣,抹一把汗)

肥仔添:    這裡是我的飯堂。

部長:        添哥

肥仔添:    你好。

(席間,添、全二人正在吃飯)

高佬全:    蘇眉即是蘇眉,味道就是不同凡響。你真沒話說。

肥仔添:    怎樣?味道好過小學釣那條。

高佬全:    差很遠,沒得比!

肥仔添:    至少肯定吃完不會到急症室。

(二人哈哈大笑)

部長:        添哥,酒到。

肥仔添:    給倒上吧。

部長:        小菜還可以嗎?

高佬全:    好吃,太好了!

部長:        那麼多點來光顧吧。

肥仔添:    一定。

部長:        慢用

肥仔添:    謝謝。(將酒遞給全)來,飲!

高佬全:    唉…

肥仔添:    你沒事嘛?愁眉苦臉,孩子還未好嗎?

高佬全:    不是兒子問題。都是我的問題。我跟人玩“窩輪”,虧蝕嚴重,欠下一身債。

肥仔添:    差很多?

高佬全:    二十多萬塊!

肥仔添:    二十多萬塊…

(添拿起酒杯喝了一口,計上心頭)

肥仔添:    高佬全,一場兄弟,那二十萬我借給你。

高佬全:    我想這不大好。

(添挪着椅子靠近全)

肥仔添:    坦白講,我也有件事想你幫忙。

高佬全:    你說罷,幫得到的我一定幫。

肥仔添:    西翼那邊那個工程,我們一直訂不到政府要的物料,到現在也未開過工。

高佬全:    不是嘛?不跟合約時間完工很麻煩。我的工作就是監管你的工程。

肥仔添:    所以我想你幫忙,把進度報告弄好一點,待我訂到貨後馬上趕工,應該明年限定時間內前完成工程。

高佬全:    你要我做假報告?犯法的!

肥仔添:    高佬全,你可當作一時看漏眼。朋友就是你幫我,我幫你。那二十萬不用擔心。

(全怒拍桌子)

高佬全:    三十多年沒見,想不到你會變成這樣。一再見面,你就叫我幹這些東西。你已經不是我認識的肥仔添。我不用你幫!

糖妹:        朋友需要互相幫助,但也一定要走正途。在防止賄賂條例中,大家切記,借錢也是「利益」的一種。幸好身為公務員的“高佬全”堅持不跟朋友借錢,若果不是,這也許是令他前途盡毀的貪污陷阱。
